  • Individual's Account numbers or Social Security Number (SSN)
  • Juvenile record information.

What Do Public Arrest Records Contain?

Stafford County Arrest Records Vs. Criminal Records

Arrest and criminal records have different purposes in Stafford County's criminal justice system. An arrest record documents everything that happens from the moment a law enforcement officer apprehends a person under suspicion of committing a crime. It includes details about the time, date, and location of the arrest, the arresting officer, the charges, and other circumstances surrounding the arrest.

On the other hand, a criminal record is a more detailed description and information on an individual's criminal history with the justice system. This record contains information on all arrests, charges, court proceedings, sentences, convictions, and any incarceration period. Law enforcement agencies and courts may give access to criminal records across the state, including Stafford County.

How Long Do Arrests Stay on Your Record?

Arrests stay on record forever. According to Virginia law, there is no distinction between misdemeanors and felonies in this regard. However, arrest records can be sealed or expunged if there was no conviction or the activities they were convicted of are no longer crimes.

Expunge Stafford County Arrest Records

  • The person was charged with assault and battery or another misdemeanor that could have resulted in a civil lawsuit.
  • The person receives an absolute pardon from the Governor of Virginia.
  • The person was the victim of identity theft, meaning they are innocent of the charges resulting from that theft.

An eligible person can apply for an expungement at any time after the case's final disposition. If the person was the victim of identity theft, they can also apply immediately. To obtain an expungement, the person must file a Petition for Expungement (FORM CC-1472) with the Stafford County Circuit Court. (§ 19.2-392.2 C). According to § 19.2-392.2 E, the petitioner must obtain one complete set of the petitioner's fingerprints from the Virginia State Police (VSP) department.

The State Police must submit the set of fingerprints to the Central Criminal Records Exchange (CCRE) with a copy of the petition for expungement. (§ 19.2-388.1). After the hearing, the court shall return the fingerprint card to the petitioner. Virginia law (§ 16.1-260) requires the petitioner to submit the form to the Commonwealth Attorney. The petitioner must have a copy of the form, including any attachments, served on the Commonwealth's Attorney in the county. (§ 19.2-392.2 D). The Commonwealth Attorney must object to the court 21 days after receiving your petition.

Stafford County Arrest Warrants

In Stafford County, an arrest warrant is a legal document addressed to a law enforcement officer from a court judge to permit an individual's arrest. It is usually issued after the judge considers the type of crime, evidence, testimony from witnesses, and the reasons to believe the suspect has committed the crime. No judge may issue an arrest warrant for an offense based on a complaint by a person other than a law enforcement officer without prior authority by the attorney for the Commonwealth (§ 19.2-71). Moreover, the judge will not issue an arrest warrant unless they are convinced of probable cause.

Do Stafford County Arrest Warrants Expire?

In Stafford County, arrest warrants do not expire. In other words, once an arrest warrant is issued, it will remain active until resolved. Two ways to resolve an arrest warrant are to ensure the suspect is placed under arrest or made to appear in court.

An arrest warrant becomes inactive if the issuing court recalls it or if the subject of the warrant dies before its execution. If the warrant is no longer active, the individual may be able to remove it from their record.
