King George County Arrest Records Vs. Criminal Records
Under Virginia law, King George County arrest records and criminal records serve distinct purposes. Arrest records document a detention when an individual is taken into custody due to suspicions of committing an offense. On the other hand, criminal records reflect an individual's adjudication history, including charges, convictions, dismissals, and sentencing outcomes.
Arrest Records: These are custodial action logs containing basic information about arrest incidents. They include the individual's name, the date and time of arrest, the alleged offense, and the jurisdiction. Law enforcement agencies that make the arrests maintain them.
Criminal Records: These are also called Criminal History Record Information (CHRI), also known as a person's "rap sheet". They include post-arrest actions such as court dispositions, sentencing details, filed charges, and information on custody. The Virginia State Police manages criminal records centrally.
How Long Do Arrests Stay on Your Record?
According to Virginia State laws, King George County Arrest records do not expire with time or fall off a person's records. They remain outstanding unless law enforcement officers execute them, or they are recalled or repealed by the court or destroyed as an unexecuted warrant, as per Virginia Code § 19.2-76.1.
Virginia Code § 19.2-76.1 requires quarterly reports from the sheriff's office for a list of unexecuted felony and misdemeanor warrants on the tenth day of April, July, October, and January annually, leading to the destruction of warrants thus:
- Unexecuted misdemeanor warrants not executed within three years of issuance and
- Unexecuted felony warrants still not executed successfully within seven years of issuance
- Unexecuted felony and misdemeanor warrants issued for a person now deceased, mistaken identity, or other legal errors
Note that unexecuted warrants meeting the required number of years for destruction, but for cases still under investigation and warrants that charge for aggravated murder are not destroyed.
As of mid-2025, Virginia offers:
- Automatic sealing for misdemeanor non-convictions
- Sealing of felony dismissals and acquittals
- Sealing for almost all misdemeanors (excluding domestic assault and DUI) after seven years
- Sealing for Level 5 and 6 felony convictions after sentenced persons are conviction-free for ten years
