Part Eleven of the Rules of the Supreme Court defines Virginia court records as any item, including documents, information, or data created, collected, received, or maintained by the Court in connection with a particular case. Most individuals or agencies use court records in background checks for employment, housing, and other purposes. This helps them verify an individual's legal history and character.

The Clerks of General District Court and Circuit Court are the custodians of court records in Hampton County. Court records can be retrieved online or in person in Hampton County. A typical court record contains the following information depending on the case type:

  • Case/defendant/plaintiff information (case number, case type, name, address, gender, filing date, status, race, locality, attorney, judgment, and date of birth)

Are Court Records Public in Hampton County?

Yes. Court records are public information under the Virginia Public Records Act and Part Eleven of the Rules of the Supreme Court.   • Documents or information whose disclosure would compromise the safety of the public, judicial officers, court personnel, or jurors or jeopardize the integrity of judicial facilities or any information technology or recordkeeping systems.

Hampton County Superior Court Case Search

Virginia's Judicial System consists of the Supreme Court, the Court of Appeals, the Circuit Courts, and the District Courts. Only the Circuit and District Courts are operational in Hampton County, and all Hampton County court records can be obtained from any of those courts.

Individuals or agencies can retrieve Hampton county arrest and criminal records by mail or drop them off at the Virginia State Police (VSP). The SP-167 form is used for Hampton county arrest and criminal record searches by individuals, the general public, private companies, and out-of-state agencies. Hampton County Criminal Court Case Lookup

The Hampton County Circuit Court and General District Court both hear criminal cases. The Circuit Court has jurisdiction over felonies and misdemeanors appealed from the District Court or originally charged in Circuit Court. The General District Court hears traffic violations and misdemeanors and conducts preliminary hearings for felonies.

Hampton County Marriage and Divorce Records

Marriage and divorce records only become part of Hampton County public records after 25 years. Confidential marriage and death records are available to immediate family members only (spouse, father, mother, child, brother, sister, and grandparents) with valid identification.

The Hampton County Circuit Court has jurisdiction over divorce cases and issues marriage licenses to intending couples. Individuals should be able to find divorce records online through the Circuit Court Case Information portal. Go to the court search field and select “Hampton Circuit Court”. Afterward, select the Civil button and conduct a search by name, case number, or hearing date. The Circuit Court does not disseminate Hampton County marriage records online. Copies of marriage and divorce records can be retrieved in person at the Circuit Court’s Clerk’s office during business hours. The names of the couple or divorce/marriage date should be provided to streamline the search.

Copies of Marriage and divorce records can also be obtained online, by mail, by drop off, or in person at the Virginia Department of Health’s Division of Vital Records. Customers must complete the necessary application form, provide a valid ID, and pay a fee of $12 before requests can be processed. Mail requesters must complete an Application for Certification of a Marriage and/or Divorce Record form.

Hampton Birth and Death Records

Hampton County birth records become public information 100 years after the birth date, while death records become public information 25 years after the event. Confidential Hampton County vital records are only open to immediate family members, such as a spouse, mother, father, child, sibling, and grandparents, with valid identification. Hampton County birth certificates can be issued to legal guardians with proof of custody.

Birth and death records may be obtained from the Virginia Department of Health’s Division of Vital Records. Requests can be made online, by mail, drop off, or in person for a fee of $12. After submitting an application online, applicants will receive an application tracking ID and email and SMS updates on the application status. Online applications take two (2) weeks to process.

Mail requesters must complete an Application for Certification of a Birth or Death Record. The application form, a check or money order, and a copy of a valid ID must be mailed to the office. The processing time for mail applications is four weeks. The mailing address is:

Requesters may drop off a completed application for birth or death records at the Office of Vital Records’ front desk. The birth or death certificate can be mailed to the customer, or the applicant will be called to pick up the certificate at the office. The Office must receive the pick-up requests no later than 2:00 p.m. and will only be released to the requester. Requests dropped off after 2:00 p.m. will be considered received the next business day. The application must include the requester’s signature, a copy of the requester’s ID, and a fee of $12 payable by payment card, check, cash, money order, or mobile pay.

Hampton County Probate Court Records

The Hampton County Circuit Court hears probate cases, such as disputes concerning wills and estates. The Clerk of Court issues probate court records online or in person to interested individuals. The Hampton Treasurer’s Office issues copies of property tax information in person during business hours. The office is open Monday through Friday from 8:30 a.m. to 4:30 p.m. The record staff will require an owner’s name, tax number, or property address to facilitate the search.
