The petition should also include the arrest date and the name of the arresting agency. Where this information is not available, the petition should state the reason for the unavailability. It should include the specific charge or offense to be expunged, the date of the final disposition, the petitioner’s date of birth, and the full name used at the time of the arrest.

The Attorney for the Commonwealth of the city or county in which the petition is filed is expected to receive a copy of the petition and file an answer or objection to it. The attorney may, within 21 days after receiving the petition, send a written notice to the court stating that they do not object.

The petitioner must then obtain a complete set of fingerprints from a law enforcement agency and provide the agency with a copy of the petition for expungement. The agency will then submit the fingerprints and petition to the Central Criminal Records Exchange (CCRE). The CCRE will send a copy of the petitioner’s criminal history, fingerprints, and other relevant documents, sealed, to the court.

After the hearing, the court will return the fingerprint card to the petitioner. If no hearing occurs, the court will destroy the fingerprint card after the expungement order is granted unless the petitioner requests its return within 30 days.

Goochland County Arrest Warrants

An arrest warrant is an official document issued by the judge, or clerk of any court of jurisdiction, or any magistrate that authorizes the arrest of the individual named in the warrant (Code of Virginia § 19.2-71)

In Virginia, an arrest warrant may be issued on written complaint of a criminal offense by a law enforcement officer or any other person so authorized by the attorney for the Commonwealth or by a law enforcement agency having jurisdiction over the alleged offense (§ 19.2-72)
