How Does The Virginia District Court Work?

The Virginia District Court system comprises courts in each city and county of the 31 judicial districts in the state. Virginia practices a unified district court system that consists of the general district courts and the juvenile and domestic relations district courts. The District Court hears cases involving:

  • Civil cases that concern monetary claims up to $25,000
  • Preliminary hearings in proceeding for felony offenses
  • misdemeanor offenses that are punishable by up to a year in jail and a maximum fine of $2,500
  • Domestic relations matters
  • Traffic violations and infractions
  • Juvenile delinquency

The District Court shares jurisdiction with the Circuit Court over civil cases that involves monetary claims between $4,500 to $25,000. In criminal and traffic case proceedings, the charges against defendants are read to them, and they have to respond by pleading guilty, not guilty, or no contest. Failure to appear in court attracts the issuance of a warrant of failure to appear. Such individuals will stand trial and the new charge, in addition to the initial charge(s).

In civil cases, the District Court has exclusive jurisdiction over claims that are less than $4,500. Individuals can initiate civil actions in Virginia by either a warrant or a complaint brought before the court. The amount of time civil proceedings takes usually depend on the nature of the complainant’s claims.

Following state laws, the Virginia District Court does not conduct jury trials, and judges preside over all cases heard at the court.

A majority of both houses of the Virginia General Assembly elect District Court judges for a six-year term. If a judgeship post is vacant when the General Assembly is not in session, a Circuit Court judge in the same district may fill in the position till the General Assembly resumes. Each judicial district has a chief judge that is elected by other judges for a two-year term. To qualify for the role of a District Court judge, candidates must be:

  • A citizen of Virginia and a resident of the district
  • A Virginia State Bar Association member for at least five years
  • Below the retirement age of seventy-three

Individuals can appeal verdicts of the District Court at the Circuit Court. A notice of appeal must be filed within ten days to the District Court’s judgment.

Individuals interested in accessing records of cases heard at the District Court can obtain them electronically via the General District Court Online Case Information System. Querying parties are required to select the District Court that the case was filed from the drop-down list. Records can be searched by the names of the involved parties, case number, and hearing date. Individuals may obtain records of civil, traffic, and criminal cases. Alternatively, copies of records can be obtained at the location of the courthouse the case proceedings occurred. Below are the locations of all District Courts:
